Introduction
These Terms and Conditions (“Terms”) govern your use of the Seek Group website (seekgroup.com.au) and any services provided by:
Seek2Migrate – Registered Migration Agent services regulated by the Office of the Migration Agents Registration Authority (OMARA)
Seek Education Solutions – Education consulting services, including study pathway advice, course enrolment support, skills assessment guidance, and related services for students, as well as consultancy and advisory services to education providers.
By accessing our website, engaging our services, or providing us with personal information, you agree to be bound by these Terms and our Privacy Policy.
Definitions
“We”, “our”, “us” – Seek Group, including Seek2Migrate and Seek Education Solutions. “You”, “your” – Any client, prospective client, website user, or third party interacting with us. “Services” – Any migration, education, skills assessment, or consulting service we provide
Scope of Services
3.1 Seek2Migrate
Services are delivered in accordance with the Migration Act 1958 (Cth), the Migration Regulations 1994 (Cth), and the Migration Agents Code of Conduct
We do not guarantee the outcome of any visa application, as decisions rest solely with the Department of Home Affairs or the relevant authority
Professional fees are payable for services rendered, and third-party fees (e.g., government charges) are your responsibility
3.2 Seek Education Solutions
We provide independent advice on education pathways, course selection, enrolment, skills assessment, and related services to students, as well as consultancy and advisory services to education providers. This may include guidance on compliance, marketing, student recruitment, and other operational matters. Admission, visa approvals, skills assessment outcomes, and regulatory approvals are determined by the relevant education provider, skills assessment body, immigration authority, or regulatory body and are outside our control.
We may receive remuneration from institutions for successful student placements; this does not affect the quality or scope of advice provided
Client Obligations
You agree to:
- Provide accurate, complete, and up-to-date information necessary for us to deliver services.
- Clients must not provide any false, misleading, or fraudulent information or documentation.
- Seek2Migrate and Seek Education Solutions reserve the right to cease acting and, where required by law, report such conduct to the relevant authorities
- Respond promptly to requests for documents or information
- Ensure you understand applicable deadlines and requirements for your application or enrolment
- Pay all agreed fees by the specified due dates
- Failure to provide required information or payments may delay or prevent us from delivering services
Fees & Payment
- Professional fees will be agreed in writing before services commence
- Government fees, translation costs, medical assessments, and other third-party charges are not included in our professional fees unless stated otherwise
- Fees are payable as per the payment schedule provided in your service/cost agreement.
- All professional fees paid to Seek2Migrate are deposited into our designated client trust account and will be held there until the agreed services, as outlined in the cost agreement, have been performed
- Late payments may attract administrative fees or suspension of services
Intellectual Property
All content on this website, including text, images, graphics, and resources, is owned or licensed by Seek Group
You may not copy, reproduce, or distribute our content without prior written consent
Limitation of Liability
To the extent permitted by law:
- We are not liable for indirect, incidental, or consequential losses
- Our total liability for any claim relating to services is limited to the amount paid by you for those services
- We are not liable for decisions made by third parties (e.g., Department of Home Affairs, education providers, skills assessment bodies) or for circumstances outside our reasonable control
Confidentiality
- We will maintain the confidentiality of all information you provide, except where disclosure is authorised by you or required by law
- Within the Seek Group, Seek2Migrate is bound by the Migration Agents Code of Conduct confidentiality provisions
Privacy
- We handle personal information in accordance with our Privacy Policy
- By engaging our services, you consent to the collection, use, and disclosure of your information as outlined in that policy
Termination
Either party may terminate services:
- In writing, with reasonable notice and in accordance with the agreements signed at the time
- Immediately, if the other party breaches these Terms and fails to remedy the breach within a reasonable time
Upon termination:
- You must pay for work completed and expenses incurred up to the date of termination
- We will return your original documents, subject to any legal retention requirements
Governing Law
- These Terms are governed by the laws of New South Wales, Australia
- Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales
Changes to Terms
We may update these Terms to reflect changes in law, regulation, or business operations. The latest version will always be available on our website
